Terms and Conditions for the supply of Mindpods products, the contract between us:
PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE
1. Format of the Contract
1.1 These terms and conditions of sale apply to all goods supplied through this website by Mindpods.
1.2 No contract exists between you and Mindpods for the sale of any goods until Mindpods has received and accepted your order and Mindpods has received payment in full (in cleared funds). Once Mindpods does so, there is a binding legal contract between us. Any terms sought by you in your order will not form part of the contract.
1.3 By way of clarification, an acknowledgement of your order will be sent to you via e-mail when you place your order, but acceptance of your offer to buy the goods will not take place until after your payment is taken and you receive your acceptance e-mail. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.
1.4 Mindpods is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our web site.
2. Description and price of the goods
2.1 The description and price of the goods you order is, as shown on our website at the time you place your order.
2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, Mindpods will then contact you by email advising you of its nearest date the goods are expected to be in stock.
2.3 Every effort is made to ensure that prices shown on the Mindpods website are accurate at the time you place your order. If an error is found, Mindpods will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If Mindpods does not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel the order, or if the order is cancelled automatically due to the expiry of the 14 day period, Mindpods will refund or re-credit you for any sum that has been paid by you or debited from your credit/debit card for the goods.
3. Payment
3.1 Payment for the goods and delivery charges can be made by any method shown on Mindpods website at the time you place your order.
3.2 There will be no delivery until cleared funds are received.
3.3 Payments shall be made by you without any deduction whatsoever. 3.4 Mindpods can also accept orders for CDs via snail mail. Please remember to let us know which CD you would like to order and to write your bankers cheque card number on the reverse of the cheque. Post your order with your cheque in £ sterling made out to Mindpods.
4. Orders for MP3s
4.1 Once you have made your preferred method of payment, your MP3 will be delivered to you.
4.2 We do not offer refunds on MP3 downloads.
5. Postal Delivery
5.1 The goods you order will be delivered to the address you give when you place your order.
5.2 Orders placed before 12.00 pm (midday) on a working day will be processed that day and will be delivered as per the requested delivery. (A working day is any day other than weekends and bank or other public holidays).
5.3 If delivery cannot be made to your address for reasons under Mindpods control, Mindpods will inform you as soon as possible and, if necessary, refund or re-credit you for any sum that has been paid by you or debited from your credit/debit card for delivery.
5.4 If the goods Mindpods delivers are not what you ordered or are damaged or defective Mindpods shall have no liability to you unless you contact Mindpods in writing at the Mindpods contact address regarding the problem within 10 working days of the delivery of goods in question.
5.5 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, Mindpods will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, Mindpods will inform you as soon as possible.
5.6 Upon receipt of your order through standard first class postage and the package does not appear to be in good condition then please contact Mindpods in writing to (see contact address). Failure to do so will result in no refund.
5.7 Every effort will be made to deliver a postal order on the Next Day order, however Mindpods cannot be held responsible for this service. Should the delivery of your order fail within the specified time for the service you paid for then contact Mindpods via email or by written letter to (see contact address).
6. Limitation of Liability
6.1 The goods are at your risk from the time of delivery. 6.2 If you are a consumer, Mindpods shall not be liable to you for any loss or damage in circumstances where: Mindpods will take all reasonable precautions to keep the details of your order and payment secure but unless Mindpods is negligent, Mindpods will not be liable for unauthorized access to information supplied by you. All credit/debit card information is not held by Mindpods. Mindpods uses PayPal to handle all secure payment transactions over the internet.
7. Shipping & Returns
7.1 We are confident that you will achieve positive benefits by using the Mindpods products that you purchase. If you are not completely happy with your purchase, we want to hear about it.
7.2 We operate a 10 day refund policy from date of purchase. Refunds on CDs are paid on receipt of returned goods.
7.3 We do not offer refunds on MP3 downloads
8. Intellectual Property Right
8.1 The Site including all MP3 downloads and or other content provided by us to you (together "Content") are all protected by our intellectual property rights, including but not limited to copyright and trademarks.
8.2 YOU MAY NOT make available copies or play any of the Mindpods products Unauthorised recording of such materials may be contrary to applicable copyright laws. All information contained on the Site is protected by copyright unless otherwise noted and may not be used except as permitted in these Terms and Conditions or in the text on the Site.
8.3 YOU MAY NOT claim to be associated with us in any way or to use our name in connection with your own practice.
9. Dealings with Third Parties and Links
9.1 The Site may provide links to other web sites or resources. As we have no control over such sites and resources, we are not responsible for the availability of such external sites or resources, do not endorse and are not liable for any content, advertising, products, or other materials on or available from such sites or resources.
9.2 Any dealings by you with any third party on or through the Site shall be solely between you and that third party and, so far as permitted by law, we shall not be liable for any loss or damage which you may incur as the result of any such dealings.
10. Security, Data Protection & Privacy Policy
10.1 PayPal is an on-line purchasing system used by millions around the world. All credit card details are encrypted and secure. Any email addresses collected on this site are treated in confidence. They will not, under any circumstances, be passed on to or shared with any other company, organisation or individual. If you no longer wish to receive communications by e-mail then please let us know.
